Traffic School for Cell Phone Ticket

Points on Record

- question from 4/7/2020 by Carina, filed under Points on Record and Cell Phone

Can I take your online traffic school course so it is not reported to DMV for a cell phone violation issued by Santa Ana police?

Hi,

I got a cell phone violation issued by the Santa Ana police County of Orange. Can I take your online traffic school course, so it is not reported to the DMV? If so, how long is the course, how much does it cost, and do you send the certificate directly to the court or do I have to print a certificate and mail it myself? Thank you.

TrafficSchool.com Says

Hello Carina-
**UPDATE EFFECTIVE JULY 1, 2021**
For all adult drivers, California law prohibits motorists from using a cellphone while driving, except when used in hands-free mode. Minors cannot use a cellphone, even if hands-free. If you were to be pulled over and issued a ticket for unlawful use of a cellphone while driving in California, currently there would be no points added to your driving record. In other words, it’s a zero-point traffic violation right now.

When this new starts on July 1st, 2021, if you are issued a cellphone violation AND you had a previous cellphone violation within the past 3 years, then 1 point will be added to your driving record. In this situation where a point is actually added to your driving record for your second cell-phone violation, you could complete traffic school and have that point removed if you haven’t attended a traffic school within 18-months. So, after July 1st 2021, a point would only be added if you received TWO cellphone tickets, and those tickets were within 36 months (3 years) of each other, citation date to citation date.

Hopefully this makes sense. Please reach out to TrafficSchool.com if you should have any additional questions.

**ORIGINAL ANSWER FOR CELL PHONE TICKETS ISSUED PRIOR TO 7/1/2021**
Cell phone tickets are non-moving violations and do not carry a point count, so traffic school is not required. However, you must pay the fine and the citation will still be on your DMV record but will have a zero point count whether you take traffic school or not. Again, traffic school is not required and will not remove the ticket from your record. Please let us know if you have any further questions.

Have a wonderful day from TrafficSchool.com-TVS #E1393.
