Oceanside Traffic School Information
Roughly 10-20 business days after being cited for a traffic infraction in Oceanside, you should receive a courtesy notice regarding your traffic ticket in the mail. Your traffic court notice will tell you if you are authorized for traffic school to mask a negligent operator point from your DMV driving record. Traffic school eligibility rules are determined as follows:
Traffic School Eligible Offenses for Oceanside Tickets
Except as detailed below in "Ineligible Offenses", a San Diego County Court Clerk can grant a request to take traffic violator school when a person with a valid driver's license requests to attend an EIGHT-HOUR traffic violator school as pre-trial diversion under California Vehicle Code sections 41501(a) and 42005 for any traffic infraction under the divisions Rules of the Road and Equipment Violations (divisions 11 and 12) Also, the traffic violation must be reportable to the CA Department of Motor Vehicles.
In plain terms, most of the common moving violations motorists in Oceanside receive are eligible for traffic school. Infractions like speeding, running a red light, failing to stop, driving too slow, bad lane changing, etc. can be dismissed with traffic school (unless you are deemed ineligible based on the disqualifications listed below).

Ineligible Offenses - Do NOT Go To Traffic School
A court clerk CANNOT grant a request to attend traffic violator school in Oceanside for a misdemeanor or criminal offense. In addition, any of the following infractions disqualify motorists from being traffic school eligible:
- An infraction that has a N.O.T.S. point count of more than one (1) point under Vehicle Code section 12810 or one and one-half (1.5) points or more under Vehicle Code section 12810.5(b)(2)
- An infraction that takes place in a vehicle that is of a commercial grade OR
- An infraction where you, the defendant, holds a commercial class license of: class A, class B, or commercial class C
- An infraction that transpires within an 18 month period after the date of a previous ticket and the defendant elected to attend a traffic school to erase the previous violation
- An infraction associated to alcohol or drug use, or alcohol or drug possession
- An infraction involving Tank Vehicles (as outlined in VCS 22406.5)
- A speeding ticket in which the alleged speed exceeds 25 miles over the posted or suitable speed limit as stated in Division 11, Chapter 7, Section 22348 of the CA Vehicle Code
- An infraction on which you, the defendant, neglected to appear under VC section 40508(a) unless the failure-to-appear charge has been settled and any fees imposed by the court have been paid
- An infraction on which the defendant has failed to appear under Penal Code section 1214.1 unless the civil monetary assessment has been paid
Important: If your mailed violation notice says you are ineligible, DO NOT enroll in traffic school to dismiss a ticket.
